Terms of Service

These Terms of Service ("Terms") govern your use of the Ruckus mobile application (the "App"). The App is operated by Gnome Bobon, LLC, a Delaware limited liability company ("Gnome Bobon," "we," "us"). By creating an account or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.

You must be at least 13 years old to use the App. If you are under 18, you may only use the App with the involvement of a parent or guardian, and only that parent or guardian may purchase a subscription on your behalf. By using the App you represent that you meet these requirements.

You sign in with your phone number and a one-time code we send by SMS. You are responsible for keeping your phone and your verification codes secure, and for all activity that happens under your account. Tell us right away if you suspect unauthorized access.

Ruckus is available on a subscription basis. We currently offer two plans:

• Monthly: $1.99 per month, billed monthly.
• Annual: $19.99 per year, billed yearly.

Both plans include a 2-week free trial when you start your first subscription. You will not be charged during the trial; if you do not cancel before the trial ends, your subscription will begin and you will be charged for the first billing period.

Subscriptions automatically renew for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple or Google account will be charged for the renewal within 24 hours prior to the end of the current period.

You can manage or cancel your subscription at any time through your Apple App Store or Google Play account settings — Ruckus cannot cancel a subscription on your behalf because billing is handled by the store. Cancellation stops future renewals; access continues until the end of the period you have already paid for.

Refunds, if any, are handled by Apple or Google under their applicable policies. We generally cannot issue refunds directly.

Ruckus is a fitness tracking tool, not a medical device. The data, calorie estimates, and goals provided by the App are approximations based on inputs you provide and on sensors that may be inaccurate. They are not medical advice.

Rucking — walking or hiking with a weighted pack — carries real physical risk. Consult a qualified healthcare professional before starting any new exercise program, especially if you have a heart condition, joint problems, are pregnant, or have any other health concern.

When using the App outdoors, stay aware of your surroundings, follow traffic and trail rules, and stop if you feel unwell. You are solely responsible for your own safety.

You agree not to:

• Use the App in any way that violates law or the rights of others.
• Falsify or manipulate ruck data, leaderboards, or social interactions.
• Harass, threaten, or impersonate other users.
• Reverse engineer, decompile, or attempt to extract source code from the App.
• Probe, scan, or attempt to breach our security or other users' accounts.
• Use the App to develop a competing product or service.

We may suspend or terminate accounts that violate these rules.

The rucks you record, profile information you provide, and other content you upload (your "Content") remain yours. By using the App you grant Gnome Bobon, LLC a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display your Content as needed to operate and improve the service — for example, to sync it across your devices, share it with friends you connect with, and back it up. We will not sell your Content or use it for advertising.

The App, including its software, design, brand, and content created by us, is owned by Gnome Bobon, LLC and protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the App for its intended purpose. All rights not expressly granted are reserved.

The App relies on third-party services including Apple App Store, Google Play, Apple HealthKit, Mapbox, Supabase, RevenueCat, Twilio, Sentry, and PostHog. Your use of those services is subject to their own terms. We are not responsible for the availability, accuracy, or content of third-party services.

You can stop using the App at any time and can permanently delete your account from Settings → Manage Account → Delete My Account. We may suspend or terminate your access if you violate these Terms or if continuing to provide the service to you is not feasible. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and dispute resolution — will survive.

The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that the data it produces is accurate, complete, or suitable for any particular purpose.

To the maximum extent permitted by law, Gnome Bobon, LLC and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the App. Our total liability for any claim arising out of these Terms or the App will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US $50.

You agree to indemnify and hold Gnome Bobon, LLC harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your use of the App, your Content, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. You and Gnome Bobon, LLC agree to resolve any dispute exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this section limits your rights under applicable consumer protection laws that cannot be waived.

We may update these Terms from time to time. If we make material changes we will notify you in the App or by email and update the "Last Updated" date. Your continued use of the App after the change takes effect indicates your acceptance of the updated Terms.
